Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Alarmify (“the App”), provided by ClearLabs (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not install or use the App.

2. Description of Application Services

Alarmify is a modern Android smart utility providing scheduled alarms, wake-up challenges (Math, Typing, Shake to Wake, Sliding Puzzle, QR/Barcode scanning, and multi-mission chains), Wake Check anti-oversleep protection, countdown timers, stopwatch timing, bedtime routines, sleep consistency streak tracking, Alarmify AI Studio, and customizable home screen widgets.

3. User Responsibilities & Battery Optimization Warning

While Alarmify uses Android’s exact alarm APIs and foreground services to trigger alarms reliably, proper operation requires cooperation from your device’s operating system, power manager, and hardware settings. As a user, you agree that you are solely responsible for:

• Setting Alarms Correctly: Verifying scheduled times, AM/PM designations, volume levels, and repeat day schedules.
• Maintaining System Permissions: Keeping required permissions active (Exact Alarms, Full-Screen Intent, Notifications, Camera for QR scanning, Microphone for AI voice input, and Location for weather).
• Managing Battery Optimization Restrictions: Modern Android devices (including devices from Samsung, Xiaomi, Huawei, OnePlus, and Oppo) employ aggressive background battery management policies (such as Doze Mode and vendor-specific app cleaners). These policies may delay or terminate background alarms if Alarmify is not explicitly exempted from battery optimization. You agree to whitelist Alarmify within your device’s power management settings to allow reliable alarm triggering.
• Device Readiness: Ensuring your device remains powered on, sufficiently charged, not in silent mode with alarms disabled, and within adequate hearing distance.

4. Wake-Up Challenges, Physical Activity & Safety Disclaimers

Alarmify provides wake-up challenges to encourage cognitive and physical alertness before an alarm can be dismissed:

• Shake to Wake Challenge (Physical Safety): The Shake to Wake challenge requires moving or shaking the device until the target count is satisfied. You agree to maintain a firm and secure grip on your device during this challenge, perform movements in an open area away from obstacles, breakable objects, and other people, and never throw or fling the device. ClearLabs is not liable for dropped devices, cracked screens, personal injuries, or property damage resulting from physical challenge participation.
• QR / Barcode Scanning: If you configure a QR or barcode wake-up challenge, you are responsible for ensuring that the target code is affixed in an accessible location with adequate ambient lighting.
• Emergency Fallback Mechanisms: If a configured challenge cannot be completed due to hardware limitations, scanning errors, or an emergency, Alarmify provides built-in fallback mechanisms (such as alternative challenge selection or volume escalation options) so the alarm can be silenced.
• No Liability for Hardware Freezes: In rare cases of operating system unresponsiveness, third-party system freezes, or unexpected hardware crashes during an alarm, challenge screens could become temporarily unnavigable. ClearLabs is not liable for any tardiness, missed appointments, lost flights, or damages resulting from challenge settings or device lockups.

5. Wake Check & Anti-Oversleep Protection

The Wake Check feature sends a scheduled notification or secondary alert 1 to 10 minutes after an alarm is dismissed to confirm that you have not fallen back asleep. Wake Check is an auxiliary convenience feature and does not guarantee physical wakefulness. You remain responsible for getting out of bed and fulfilling your schedule.

6. Alarmify AI Studio & Generative AI Terms

Alarmify includes conversational productivity features powered by Google Cloud Vertex AI (Gemini model API):

• Informational & Productivity Purpose: Alarmify AI is designed to assist you with alarm scheduling, timer settings, sleep habit suggestions, and conversational productivity. AI responses are generated automatically and should never be relied upon as medical advice, psychiatric counseling, clinical sleep disorder diagnosis (such as sleep apnea or insomnia), or emergency instructions.
• Acceptable Use: You agree not to use Alarmify AI for generating abusive, unlawful, harassing, harmful, defamatory, or fraudulent content. We reserve the right to restrict AI access to any user violating acceptable use standards.
• Interaction Quotas: To maintain server reliability and prevent automated abuse, daily interaction limits apply (e.g. starter chats for Free tier; 50 daily interactions for Alarmify Pro subscribers). Quotas reset daily at local midnight.

7. Alarmify Pro Subscriptions, Free Trials & Google Play Billing

Alarmify offers an optional premium subscription (“Alarmify Pro”) providing unlocked features:

• Pro Benefits: Multi-mission chaining (up to 5 sequential challenges), Shake to Wake challenge, AI Morning Voice Briefing, 50 daily AI chats, 4 streak savers capacity, exclusive Pro live/photo wallpapers, and original master tones.
• 7-Day Free Trial Terms: Eligible new subscribers may receive a 7-day free trial. If you do not wish to be charged, you must cancel your subscription in Google Play at least 24 hours before the 7-day trial period concludes. If not cancelled, the trial will automatically convert to a recurring paid subscription at the displayed rate.
• Recurring Billing & Automatic Renewal: Subscriptions are billed on a recurring basis (monthly or annually as selected, at the localized currency rate displayed in Google Play). Your subscription automatically renews at the end of each billing cycle unless cancelled before the renewal date.
• Cancellation & Subscription Management: You can manage or cancel your subscription at any time directly through the Google Play Store (Google Play Store → Profile Icon → Payments & subscriptions → Subscriptions → Alarmify). Upon cancellation, you retain full access to Pro features until the conclusion of your current paid billing period. No partial refunds are issued for unused days within an active cycle.
• Refund Policy: All subscription purchases and billing transactions are processed exclusively by Google Play. Refund requests are subject to Google Play’s standard refund terms and must be submitted directly through Google Play support.

8. Google Authentication & Optional Cloud Backup Terms

Alarmify provides optional connected features using Google Sign-In and Firebase Cloud Firestore:

• Account Association: Cloud backups are tied securely to your authenticated Google account credentials. You are responsible for safeguarding your Google account login.
• Service Availability: Cloud synchronization and support ticket delivery depend on third-party cloud infrastructure and active internet connectivity. We do not guarantee uninterrupted server availability.
• Cloud Data Controls: You may permanently delete your cloud backup document and account association at any time via Settings → Profile → Delete Account & Data, or by submitting a web-based data deletion request to ssp99a@gmail.com.

9. Custom Media & User Content

If you select custom audio ringtones, music files, or background media stored on your device, you represent and warrant that you possess all necessary rights and licenses to use such content for personal alarm customization. You retain full ownership of your personal media files.

10. Intellectual Property

All rights, titles, and interests in and to Alarmify—including software code, visual design, custom UI components, icons, logos, branding, graphics, sound assets, and documentation—are the exclusive intellectual property of ClearLabs. You may not modify, reverse engineer, decompile, or redistribute the App binary without express written permission.

11. Disclaimer of Warranties

ALARMIFY IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL OPERATE UNINTERRUPTED, ERROR-FREE, OR THAT ALARMS WILL TRIGGER UNDER ALL HARDWARE, SYSTEM SLEEP, AND BATTERY OPTIMIZATION CONDITIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLEARLABS, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING BUT NOT LIMITED TO MISSED ALARMS, MISSED FLIGHTS OR APPOINTMENTS, EMPLOYMENT TARDINESS, LOSS OF WORK OR PROFITS, LOSS OF DATA, OR DEVICE MALFUNCTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE ALARMIFY.

13. Termination & Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time. Material changes will be posted on this website with an updated revision date. Your continued use of Alarmify following any updates constitutes acceptance of the modified Terms.
